How to lose 50,000 PLN on a poorly described machine warranty?
In October 2023, one of our clients near Krakow bought a new plastic injection molding machine for an amount exceeding 1.2 million PLN. He thought the standard warranty card protected him from any failure for the first two years of use. The truth turned out to be brutal and cost him exactly 53,420 PLN in additional expenses during just one week of downtime.
The trap in the authorized service clause
Most entrepreneurs in Małopolska assume that a warranty is a warranty and there's no need to dig into it during purchase. Our client from Niepołomice signed a contract where a clause about 'obligatory inspections every 450 operating hours' was added in small print. The problem was that the manufacturer's service had the right to arrive for such an inspection within 14 business days of notification. When the machine worked three shifts, the hour limit was exhausted instantly, and the machine stopped because the system blocked operation without a service code. We count every penny, so it's easy to calculate: 14 days waiting for a technician is 336 hours of dead production time.
The machine supplier deliberately constructed the clauses to force the client to buy an additional 'Premium Service' package for another 18,200 PLN per year. Without this, every hour of downtime generated losses that no one wanted to cover. At Małopolska Grupa Doradcza, we check facts, not salesperson promises, which is why we always analyze these time limits before signing any proforma invoice. In this specific case, the lack of one comma in the definition of 'response time' led to a situation where the technician appeared only after 11 days, and the company had to pay contractual penalties to its recipients for delays in component deliveries.

Wear parts, or what you are really buying
Another flashpoint in this story was the so-called wear parts, which according to the supplier were not covered. In February 2024, the main hydraulic cylinder in the machine broke. The manufacturer stated it was an element subject to natural wear, even though the machine had only worked 1,482 hours. The cost of the new element was 24,300 PLN net, plus express transport from a warehouse in Germany for 3,150 PLN. The client was convinced that such an expensive machine couldn't break so quickly, and if it did, the repair would be free. Facts on the table: the clauses in the contract were so vague that the supplier's lawyers won every complaint attempt.
During our retrospective analysis of the documentation, we found 7 other points that excluded the manufacturer's liability for seals, bearings, and control electronics in case of voltage fluctuations in the network. And yet every hall in Niepołomice or Skawina has voltage drops under heavy load. Zero fluff – if you don't fight for a warranty clause on the 'entire device without exclusions' at the time of purchase, you will later pay for every bolt. Since 2017, we have already seen 47 similar cases where saving on advisory during purchase backfired with huge bills for post-warranty service that de facto started in the third month of work.

How to secure 118 projects a year?
At Małopolska Grupa Doradcza, we currently oversee 118 investment projects across the region. Our method is simple: we don't believe in advertising brochures. Every contract for the purchase of a machine over 200,000 PLN must pass through our technical-legal filter. We check not only service response time but also the availability of spare parts within a 150 km radius of Krakow. If the nearest warehouse is in Shanghai, we inform the client that the risk of downtime is 21 days. These are hard data that allow for price negotiations or changing suppliers at the tender stage.
For example, for a company from Myślenice, we negotiated a clause in March 2024 about a replacement machine at the supplier's expense if a repair exceeds 48 hours. Does this seem impossible? For a salesperson who wants to close the quarter with a good result, everything is possible if hard conditions are set. Our team, which currently employs 14 specialists, catches such attempts to shift risk to the buyer every day. In 2023, we saved a total of 4.7 million PLN this way, which our clients would have had to spend on unplanned repairs and downtime.

Action plan for the next 72 hours
If you are currently planning the purchase of a new production line or a single machine, don't wait for the final version of the contract. The first step should be sending us the draft warranty conditions for a free preliminary audit. We respond in an average of 2h 14min because we know that in business, time is specific money. Often, after a cursory reading, we see that a '5-year' warranty is actually 1 year of full protection and 4 years of paid inspections, the total of which exceeds the value of a new machine. We check facts; we don't get fooled by marketing slogans about 'reliability'.
Perhaps you think your lawyer has already checked this. Lawyers know the civil code well but rarely know how fast a head in a fiber laser wears out when working with 12 mm sheet metal. We combine technical knowledge with financial knowledge. Heads-up: the worst contracts are those the supplier calls 'standard'. At Małopolska Grupa Doradcza, we know that the standard usually provides the least protection. We invite you for a 20-minute consultation, during which we will show you the blacklist of machine suppliers with whom our clients have had the most problems over the last 3 years.
